Terms of Service

1. Acceptance of Terms

By accessing or using ZimRentals.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and ZimRentals (Pvt) Ltd, registered and operating in Zimbabwe.

2. Platform Use

ZimRentals provides an online marketplace connecting landlords and tenants in Zimbabwe. The Platform offers property listings, tenant verification, lease management, invoicing, and related rental services. You may only use the Platform for lawful purposes and in accordance with these Terms.

You must be at least 18 years of age to register an account. By registering, you warrant that all information you provide is accurate, current, and complete.

3. Landlord Responsibilities

As a landlord on ZimRentals, you agree to:

• Provide accurate and truthful property listings, including correct pricing, location, and amenities
• Maintain properties in a habitable and safe condition in accordance with Zimbabwe's housing regulations
• Only submit tenant reports that are truthful, accurate, and based on documented evidence
• Not discriminate against tenants on the basis of race, gender, religion, disability, or any other protected characteristic
• Honour lease agreements once signed and not engage in unlawful eviction
• Keep subscription fees current to maintain access to premium features

4. Tenant Responsibilities

As a tenant on ZimRentals, you agree to:

• Provide accurate identity, employment, and reference information during profile setup
• Pay rent on time as per the agreed lease terms
• Maintain the property in good condition and report maintenance issues promptly
• Not sublet or allow unauthorised occupants without landlord approval
• Vacate the property at lease expiry unless a renewal is agreed in writing
• Accept that your rental history and reputation score may be visible to landlords on this platform

5. ZimScore Tenant Reputation System

ZimRentals operates a Tenant Reputation System ("ZimScore") that assigns a score from 0–100 to each tenant based on:

• Verified positive and negative reports submitted by landlords
• Payment history and lease compliance
• Admin-moderated reviews and dispute outcomes

All reports are moderated by ZimRentals administrators before affecting a score. Tenants may dispute inaccurate reports through the Platform's dispute resolution process. ZimRentals reserves the right to reject false or malicious reports from landlords.

6. Fees & Payments

ZimRentals offers subscription plans for both landlords and tenants. Subscription fees are billed monthly and are non-refundable. Plans include:

• Tenant Basic (Free): Browse and apply to listings
• Tenant Premium ($0.99/month): Unlock landlord contact details
• Landlord Standard ($5/month): Up to 5 listings, 4 images per property
• Landlord Premium ($50/month): Unlimited listings, full analytics, credit ratings

ZimRentals reserves the right to modify pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Prohibited Conduct

You must not:

• Submit false, misleading, or fraudulent information
• Use the Platform to conduct illegal activities or facilitate fraud
• Attempt to reverse engineer, scrape, or copy Platform data without permission
• Harass, threaten, or abuse other users of the Platform
• Create multiple accounts to circumvent bans or reputation consequences
• Use automated bots or scripts to interact with the Platform

Violations may result in immediate account suspension, legal action, and reporting to relevant Zimbabwe authorities.

8. Termination

ZimRentals reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or conduct detrimental to the Platform or other users. You may close your account at any time by contacting support. Upon termination, your tenant reputation record may be retained as provided in our Privacy Policy.

9. Limitation of Liability

ZimRentals acts as a marketplace and is not a party to lease agreements between landlords and tenants. We are not responsible for the conduct of users, the accuracy of property listings, or outcomes of rental arrangements. To the fullest extent permitted by Zimbabwe law, ZimRentals' liability is limited to the amount paid in subscription fees in the 3 months prior to any claim.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe. For consumer disputes, you may also have rights under Zimbabwe's Consumer Protection Act and Data Protection Act 2021.
